Acceptance of Terms

By accessing or using the Website, placing an order, or completing any purchase, you expressly acknowledge and agree to be bound by these Terms and Conditions, as well as our Privacy Policy. If you do not agree to these Terms, you must refrain from using the Website or completing any transaction.

1. INTRODUCTION AND CONTRACTING PARTIES

1.1. These Terms and Conditions (“Terms”) govern your access to, and use of the DRM LND Kuwait online store (“Website”) and the purchase of products offered by HM International Holding Company W.L.L. (“HM International”, “we”, “our”, or “the Company”).

1.2. The Website is operated solely within the State of Kuwait by HM International Holding Company W.L.L., a limited liability company established under Commercial Registration No. 475910, registered office at Al-Sour Street, Al-Tijaria Tower, Kuwait City.

1.3. HM International is the authorized local franchisee of the DRM LND brand. All purchases made through this Website constitute a contract exclusively between you and HM International Holding Co. W.L.L..

1.4. These Terms apply to all visitors, users, and customers (“you”). By accessing or using the Website, you confirm your acceptance of these Terms.

1.5. We may revise these Terms periodically. Updated versions take effect immediately upon posting on the Website.

2. NATURE OF PRODUCTS

2.1. DRM LND products are highly customizable and rely on user creativity, including bead arrangements, character selection, and DIY assembly.

2.2. While we strive to display colors and product images accurately, variations may occur due to device settings. Such variations do not constitute defects.

2.3. When utilizing our DIY design tools, you bear full responsibility for the accuracy of designs, spelling, placement, and aesthetic choices. HM International shall not be liable for user-generated customization errors.

3. ORDERS AND ACCEPTANCE

3.1. All orders are subject to acceptance, availability, and verification.

3.2. We may decline or cancel orders for reasons including (without limitation):

  • Out-of-stock items

  • Pricing or system errors

  • Suspicion of fraudulent activity

  • Custom designs containing offensive, unlawful, or inappropriate content under Kuwaiti public morals laws.

3.3. A contract is formed only when we issue a written order confirmation.

4. PRICING AND PAYMENT

4.1. All prices are denominated in Kuwaiti Dinar (KWD) and include applicable customs duties, unless otherwise stated.

4.2. Delivery fees appear at checkout.

4.3. Accepted payment methods include K-NET, Visa, MasterCard, and cash-on-delivery (if available). You represent that you are authorized to use the selected payment method lawfully.

4.4. In case of pricing errors, we reserve the right to correct or cancel affected orders before or after confirmation, with full refund where applicable.

5. RETURNS, EXCHANGES, AND REFUNDS

A. Standard Products (Non-Customized)

5.1. You may return or exchange standard products within 14 days of receipt, provided:

  • The product is unused

  • All original packaging is intact

  • Proof of purchase is presented per Kuwait Consumer Protection Law No. 39 of 2014.

B. Customized, Personalized, or DIY Products – FINAL SALE

5.2. Under Kuwaiti consumer law governing goods produced to customer specifications, customized and DIY-designed products are non-returnable and non-refundable once production has started.

C. Manufacturing Defects

5.3. You must notify us within 24 hours of delivery regarding any defect.

5.4. Upon verification, we may offer a replacement or full refund at our discretion.

6. DELIVERY, TITLE & RISK

6.1. Delivery periods shown on the Website are indicative estimates only.

6.2. We are not liable for delays caused by circumstances beyond our reasonable control, including but not limited to customs delays, supply chain disruption, or force majeure events.

6.3. Title and risk pass to you upon delivery to the address provided.

6.4. You are responsible for providing accurate and complete delivery information and for responding promptly to delivery personnel to facilitate successful delivery. You are expected to cooperate with the delivery team in a respectful and professional manner. Re-delivery fees may apply in cases of incorrect address details, failure to respond to delivery attempts, or conduct that prevents completion of the delivery. All personal data shared for delivery purposes will be handled in accordance with our Privacy Policy.

7. PRODUCT SAFETY & LIMITATION OF LIABILITY

7.1. Safety Warning: DRM LND accessories contain small parts. They are not intended for children and pose a choking hazard. You assume full responsibility for supervising any minors.

7.2. To the maximum extent permitted by Kuwaiti law:

  • HM International is not liable for indirect, incidental, punitive, or consequential damages arising from your use or misuse of the products.

  • HM International makes no warranty beyond what is expressly required under Kuwait law.

7.3. Nothing in these Terms limits liability where prohibited under Kuwaiti law (e.g., fraud or intentional misconduct).

8. ELIGIBILITY, ACCURACY & ORDER MODIFICATIONS

8.1. You must be at least 21 years of age to purchase.

8.2. You warrant that all personal information provided is accurate and up to date.

8.3. Orders cannot be modified after the confirmation email is issued due to the personalized nature of our products.

8.4. Products are sold for personal use only. Commercial resale requires our written approval.

9. ORDER ACCEPTANCE, CANCELLATION & REFUNDS

9.1. We may cancel an order at our discretion, including for offensive custom designs, pricing errors, or operational constraints.

9.2. If cancellation occurs after payment, you will receive a full refund to your original payment method.

10. GOVERNING LAW

These Terms and your purchase are governed exclusively by the laws of the State of Kuwait.

11. DISPUTE RESOLUTION – MANDATORY ARBITRATION (Kuwait)

11.1. Any dispute, controversy, or claim arising out of or relating to these Terms, your purchase, or your use of the Website shall be finally resolved by arbitration administered by the: Kuwait Chamber of Commerce and Industry – Commercial Arbitration Centre.

11.2. The tribunal shall consist of one sole arbitrator appointed in accordance with the Centre’s Rules.

11.3. Seat of Arbitration: Kuwait City, State of Kuwait.

11.4. Language: English.

11.5. The arbitrator’s award shall be final, binding, and enforceable in accordance with Kuwaiti Law.

11.6. Parties waive any right to bring or participate in class or group actions.

12. NO WAIVER

Failure by the Company to exercise any rights does not constitute a waiver of those rights.

13. SEVERABILITY

If any provision is held invalid, the remaining provisions remain enforceable to the fullest extent permitted by law.

14. INTELLECTUAL PROPERTY & USER CONTENT

14.1. All trademarks, designs, images, and content on the Website are owned by DRMLND AB or licensed to HM International.

14.2. You may not reproduce, modify, distribute, or extract any content without prior written consent.

14.3. By submitting reviews, photos, or other content (“User Content”), you grant HM International a non-exclusive, royalty-free license to use such content for marketing and promotional purposes.

14.4. We may remove any User Content deemed unlawful, offensive, or non-compliant with Kuwaiti public morals.
