Welcome to DRM-LND ("DRM-LND," "we" or "us") website, DRM-LND.com (the "Website"). These terms and conditions (the “Conditions”) apply to the orders placed by the customer (“you”) in your capacity as a consumer for purposes outside of commercial or professional activities. By using the Websites and placing an order, you agree to be bound by these Conditions.

Please review the Conditions and make sure that you understand them before you make an order. (If you reside outside of the EU, please note that our conditions for RoW will apply and if you reside in the US, the local conditions for the US will apply. We reserve the right to change these Conditions at any time without prior notice. The Conditions available on the Website at the time of your order, is the version applicable to your order.

Placing an order

In order to place an order you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us.

Please note that all orders are subject to availability and that the inclusion of any products on the Website at a specific time does not mean that these products will be available at any time.

You can only place your order via the Website. Please make sure that all details you provide are true and correct. We will use the details provided to communicate with you about your order.

Our contract

When you have placed an order, you will receive an e-mail confirming your order. Please note that this email will be an acknowledgement only and will not constitute acceptance of your order. A contract will be formed when we send you an e-mail confirming that the products have been dispatched. Only those products listed in the confirmation e-mail sent at the time of dispatch will be included in our contract. If we have already received payment for non-available products, we will refund the applicable amount using the same method used to make the payment.

Pricing

The prices stated on the Website include Value Added Tax (VAT) and are final prices. Please note that the prices do not include delivery costs, which are charged separately.

Whilst we try and ensure that all details, descriptions and prices that appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled.

DRM-LND is not responsible for any changes in currency or conversion rates that your bank or credit card company may use when charging in your country’s currency.

Payment

We accept card payments by Visa, MasterCard, American Express and several local payment options. Upon receiving your order we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfil the transaction. Please note that the products will not be dispatched until the pre-authorisation check has been completed. Your card will be debited once the order has been accepted. All payments are handled by Adyen.

Delivery

Orders within the EU are sent from Täby, Sweden. When placing an order, you may choose standard shipping.

We always strive to deliver your ordered products as soon as possible. However, due to unexpected events the delivery times are sometimes longer, for example as a result of postal delays or force majeure events. Dispatch times may also be longer during times with higher sales volumes, such as holiday seasons. Shipping costs will be added where applicable and for the delivery option chosen. Returns

DRM-LND provides high-quality DIY products. Once you have started creating your product, no returns can be made.

We strongly recommend that you read and watch the assembly instructions . Failing to do so may lead to a less satisfactory experience.

DRM-LND has a 14-day return policy with the following requirements:

Customer must provide receipt.
Packaging must be intact and sealed.
The product has not been assembled.
The product is in new and unused condition.

Returns will only be accepted if labels and original packaging are unopened, fully intact, and products have not been damaged or altered. DRM-LND cannot accept returns if the seal has been broken.

You are responsible for the shipping of returned items back to DRM-LND. Items lost in transportation will not be compensated for. Any shipping charges for returns will be at your own expense, postal services may be used for the return. Please consult your local postal office for the official postal fees.

Refunds for returned products will be made within 14 days of receipt of the returned product, using the same payment method used to make the payment. Please note that the refund will be made for the entire product cost (including VAT), however excluding shipping costs.

Please note that products purchased at www.drm-lnd.com cannot be refunded at any stores. We do not accept exchange of products.

If you have purchased DRM-LND products in our retail stores and staff has been kind enough to assist you with the assembly, please remember that the staff are not professionally trained jewellers and are not responsible for the quality of the assembled product.

In case of defect items in your order, DRM-LND will replace these items without cost. DRM-LND will not refund any orders in full due to defect items.

Right of cancellation

If you reside within the EU, you may cancel the contract for any reason and without a justification within 14 days from receiving the products from DRM-LND. To exercise this right, you must send us a clear message of your wish to cancel the contract, either in writing to DRM-LND, Framnäsvägen 8A, 182 63 Djursholm, Sweden, or contact our support, or by using and submitting the standard form issued by your local Consumer Rights Authority. You must also, at your own cost, return the products without delay and at latest within 14 days from your message to cancel the contract.

We will refund you the money paid for the products that have been cancelled, using the same method used to make the payment, unless you have expressly agreed otherwise. This includes the delivery costs for standard delivery, except for such additional delivery costs if you have chosen another, more expensive delivery method than our standard delivery. We will not cover your return. The refund will be made within 14 days from receiving your message to cancel the contract, although we may wait until we have received the products back or you provided evidence of having sent back the products.

Discount codes

Discount or promotional codes may from time to time be offered, please note that the terms and conditions provided in connection with such discount codes apply. Only one promotional discount code can be applied to an order.

Intellectual property

Unless otherwise noted, all materials, including, but not limited to, images, illustrations, designs, icons, photographs, video clips, and written and other materials that appear as part of the Website (collectively, the "Content") are copyrights, trademarks and/or other intellectual properties owned, controlled or licensed by DRM-LND. The Content, and the Website as a whole, are intended solely for personal, non-commercial use by the users. You may download or copy the Content displayed on the Website for your personal, non-commercial use only. No right, title or interest in any downloaded materials or software is transferred to you as a result of any such downloading or copying. You may not reproduce (except as noted above), publish, transmit, distribute, display, modify, create derivative works from, sell or participate in any sale of, or exploit in any way, in whole or in part, any of the Content, the Website, or any related software. The Website as a whole is protected by copyright and all worldwide rights, titles and interests in and to the Website are owned by DRM-LND.

User-generated content

Our website includes user-generated content from, for example, social media. DRM-LND accepts no legal responsibility for such material. In case you suspect a copyright infringement, infringement of another right, or for any other reason, you would be offended by content posted on the website, please contact our Support team.

Drm-lnd designers

By creating an account on the website and becoming a DRM-LND designer, you accept receiving promotional material in form of email marketing from DRM-LND. You can unsubscribe from these emails at any time.

At DRM-LND, we highly value the creative work of our designers, and as such, we ensure that all copyrights remain with them. However, we would like to bring to your attention that when you create a profile page on our platform, you are acknowledging and consenting to the fact that DRM-LND has the right to utilize the content, video, pictures, username, profile and design that you upload for advertising purposes. This means that we may showcase your incredible creations to a wider audience, helping to promote your talent and generate more exposure for your work. We believe that this mutually beneficial arrangement allows us to support artists like you by providing a platform to showcase your artistry while also helping us to grow as a community. Your creative journey is important to us, and we are committed to fostering a positive and empowering environment for designers to thrive.

Furthermore, as a creator on our platform, you have the opportunity to turn your design ideas into actual products. Once you create a product, we have the ability to sell it through various channels, including our online platforms, retail shop, and wholesale accounts. This allows us to reach a wide range of customers and maximize the exposure of your designs.

In terms of compensation, we want to ensure that you are fairly rewarded for your creative efforts. Therefore, for each sale of your uploaded product, you will receive a commission of 10% based on the total sales generated. This means that as your designs gain popularity and generate sales, you will earn a percentage of the revenue. As part of our design commission, we are proud to contribute an additional 5% to a non-profit organization (NPO). The NPO will be selected by you and will align with your beliefs, supporting important causes while we work together on your project. Helping us make a positive impact in our community.

Rest assured that all sales of your uploaded products are carefully tracked and monitored. This allows us to provide you with accurate and transparent information regarding the performance of your designs in the market. You will have access to detailed sales reports, enabling you to gauge the success of your products.

All your uploaded images, videos, and content related to your created product can be used by us in any manner, both online and in stores, for advertising and social media content to promote your product and profile. This includes the use of your content for any purpose of DRM-LND.

We understand the importance of safeguarding your intellectual property and take measures to ensure that your designs are not copied or reproduced without your consent. Our platform is equipped with security features to prevent unauthorized use of your content, and we have a dedicated team that monitors for any potential infringement.

In addition to the financial benefits, being a creator on our platform also provides you with the opportunity to connect with a vibrant community of like-minded individuals. You can interact with other creators, share ideas, and collaborate on projects. We believe that fostering a supportive and creative environment is crucial for your growth and success as a designer.

By joining our platform and creating a profile page, you become part of a community of passionate individuals who are committed to bringing unique and innovative designs to the world. We are thrilled to have you on board and look forward to witnessing your creativity flourish. Together, we can make a lasting impact in the world of design and creativity.

Once you have accumulated a total of 999 kr in earnings, you will become eligible to request a payout. This means that once you have reached this threshold, you will be able to receive the money you have earned.

We understand the importance of complying with local tax regulations and ensuring that you receive the funds you are entitled to. Therefore, we have established a clear payout policy based on the amount you are eligible to receive.

When it comes to the amount 999 kr, we are happy to pay out the full amount without requiring any reporting from your end. This means that you can enjoy the entirety of the funds without any additional steps.

For amounts falling between 1000-9999 kr, we will still pay you the full amount. However, it will be your responsibility to report and fulfill your own tax obligations. This allows you to have control over your tax affairs while still receiving the full payment you are entitled to.

In the case of amounts surpassing 9999 kr, we will deduct the applicable local taxes before disbursing the remaining amount to you. This ensures that you are in compliance with tax regulations and receive the net amount after the necessary deductions.

For payouts of 999 kr or more, you have the option to select payout method. It is important to note that we will keep the payment details you submit on file for future reference.

Privacy

Our Privacy Policy describes the collection and use of information on the Site.

Colours

We have made every effort to display as accurately as possible the colours of our products that appear on the Website. However, the actual colours you see may depend on your monitor and we cannot guarantee that your monitor's display of any colour will be accurate.

Choice of law

These Conditions shall be construed in accordance with the laws of Sweden, without regard to any conflict of law provisions. If you act as a consumer and reside in the EU, you are always protected by mandatory provisions of the laws of your country of residence. Any dispute arising under these Conditions shall be resolved by the country of Sweden, which means that we may both submit a claim to the district court of Stockholm, Sweden. However, as a consumer, you may also submit a claim to enforce your consumer protection rights in connection with these Conditions in the EU country in which you live.

If you reside in the EU, the European Commission provides a platform for Online Dispute Resolution (ODR), which offers the possibility to try and reach an out-of-court settlement for complaints arising from online purchases. You can access the platform here.

Faulty items

Nothing in these Conditions limits the statutory warranty regulations applicable in your country of residence. If you have a complaint regarding a material or manufacturing fault, please contact our customer support within reasonable time after you noticed the defect and describe your matter as detailed as possible. The customer support team will then help you further with your matter.

Limitation of liability

DRM-LND or its affiliated entities is not liable for any business-related damages or losses, neither for losses that are not caused by a breach on our side.

Nothing in these Conditions will exclude or limit our liability for any matter that it would be unlawful for us to limit or exclude our liability according to mandatory law.

The Website and the Content are provided "as is" without warranties of any kind. To the fullest extent permitted by law, DRM-LND disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.

Miscellaneous

If any portion of these Conditions is held to be invalid or unenforceable, the invalid or unenforceable portion shall be modified in accordance with the applicable law as nearly as possible to reflect the original intention of the applicable provision, and the remainder of these Conditions shall remain in full force and effect.

DRM-LND reserves the right to assign or pledge to third parties any claim for payment which have arisen in connection with your purchase.
